Nursing Home Employee Injured Back While Lifting Obese Patient

Melissa Scott, an employee of a nursing home in Kilgore, Texas, has filed suit against the Willow Bluff nursing home alleging that she sustained personal injuries to her back two years ago during the task of helping aides lift a 300-pound patient after the lift machine at the facility broke.

 

Scott filed the suit in the District Court of Jefferson County, Texas on August 18 claiming that on September 10, 2006, she helped move the obese patient from a chair to the bed causing her to suffer “immediate severe pain.” The suit says that at that time, Scott and the other aides were not able to use the facility’s lifting machine.

 

According to the suit, Scott notified the appropriate personnel at Willow Bluff of her injury and later that same day went to the emergency room with complaints of severe pain in her lower back. The suit said that she had suffered a central disc hernia in her lower spine.

 

The suit alleges negligence on the part of Willow Bluff for its failure to provide a safe work place and proper lifting equipment for Scott. She seeks damages for past and future mental anguish, impairment, lost earnings, medical expenses, and disfigurement.
