Man Injured Back While Helping Move Couch

The owners of a furniture showroom in Orange County, Texas find themselves as the defendants in a suit filed by a neighbor they asked to help them move a couch. The neighbor claims that he would not have sustained personal injuries to his back had be been provided with the proper safety equipment.

Nearly two years ago, the owners of Interior Design Studio, Jerry and Leeann Norman, asked Christopher Martinez, their office park neighbor, to aid them in moving a couch. Now he has filed suit against the couple for the back problems he alleges that he sustained.

Martinez filed his suit in the Orange County District Court on August 6.

In his suit, Martinez, who had a business next door to Interior Design Studio, alleges that on September 6, 2006, he was asked by the Normans to help them move a couch from their warehouse to the showroom floor.

The suit says that they loaded the couch into a truck and drove it to the front of the business to be placed on the showroom floor. The suit alleges that Martinez was placed in a position to hold and lift the couch which caused him to twist his back.

Martinez claims that he was forced to undergo surgery after hurting his back due to the Normans’ alleged negligence.

According to Martinez, the Normans were negligent in their failure to follow proper moving procedures and failure to ensure that there was a route available that was safe and accessible while moving the furniture.

Martinez seeks damages for past and future pain, mental anguish, medical expenses, lost earnings, and impairment.
